Harassing Bill Collectors

How to stop Bill Collectors Harassing Calls

⚠️ Sneaky Tricks Bill Creditors Use to Get You to Pay

1. 💬 “Just make a small payment…”

This is the oldest trick in the book.

They’ll say:

“Just send us $5 today to keep your account in good standing.”

Why it’s a trick:
If the debt is too old to sue you for (called time-barred), that tiny payment starts the clock over and makes the debt legally active again.

2. 📅 Restarting the Statute of Limitations

They might try to get you to:

    • Admit you owe the debt
    • Promise to pay
    • Make any small payment

Why?
Because all of those can legally “reset” the statute of limitations, even if it had expired before.

⚠️ Once reset, they can legally sue you again!

3. 🧑‍⚖️ Pretending to Be Law Offices or Government Agencies

Some shady collectors send letters or leave voicemails that sound like legal threats:

“You are being investigated…”
“You must call this legal office immediately.”
“You’ll be served at work.”

🛑 Scare tactic. They’re hoping you panic and pay without asking questions.

They are not allowed to lie about who they are or threaten legal action they can’t actually take.

4. 📠 Fake or Old Debt Notices

They might:

    • Send fake “bills” for debts that aren’t yours
    • Mix you up with someone else with a similar name
    • Try to collect on a debt that was already discharged in bankruptcy

Always ask for proof before paying anything!

✉️ You can send a letter saying:

“I dispute this debt. Please send proof you have the right to collect.”

5. ⌛ Acting Like You’re Out of Time

They’ll say things like:

“This is your final chance.”
“If you don’t pay by 5 PM today, we’re filing a lawsuit.”
“You have 24 hours to respond.”

😠 These threats are usually empty — they just want you to act fast before thinking.

6. 🤐 Not Telling You Your Rights

They won’t say:

    • That you have the right to dispute the debt
    • You can ask for proof
    • That the debt may be too old to sue for

📢 If they don’t explain your rights in writing within 5 days of first contact, they’re breaking the law.

7. 🕵️ Calling from Fake Names or Numbers

They may spoof phone numbers or use fake names like:

“Processing Department” or “Legal Enforcement”

📵 If the caller won’t tell you:

    • Who they are
    • What company they’re with
    • Their address

That’s a huge red flag.

8. 📝 Threatening Credit Damage — Even If It’s Illegal

They may say:

“We’ll ruin your credit if you don’t pay today.”

But if the debt is:

    • Older than 7 years
    • Already discharged in bankruptcy
    • Not yours at all

👉 They can’t report it legally!

🛡️ Final Tip: Know Your Rights Under the FDCPA

The Fair Debt Collection Practices Act protects you.
Collectors cannot:

    • Harass or threaten you
    • Call at weird hours
    • Pretend to be someone else
    • Lie about the amount or legal status of a debt

☎️ Tricks to Avoid Bill Collector Calls (The Right Way!)

Getting nonstop calls from bill collectors? It’s stressful, but you have rights, and there are smart ways to stop those calls without breaking the law.

🚫 1. Tell Them to Stop — In Writing

You have the right to say: “Don’t call me anymore.”

📬 Send a letter (or email if allowed) that says:

“I’m requesting that you stop contacting me by phone. All future communication must be in writing.”

✅ Under the Fair Debt Collection Practices Act (FDCPA), they must stop calling you!

📌 Keep a copy of the letter and send it by certified mail if possible.

📵 2. Block the Number

If they don’t listen right away:

    • Use your phone’s “Block Number” feature
    • Use a call-blocking app like Hiya, Truecaller, or Nomorobo

They might call from a different number, but you can block that too.

📅 3. Control When They Can Call

Even if they’re allowed to call, they can’t call whenever they want.

🕒 By law, they:

    • Can’t call before 8 AM or after 9 PM
    • Can’t call at work if you tell them not to

Just say:

“You’re not allowed to contact me at work or during work hours.”

🧠 4. Don’t Admit to the Debt Over the Phone

Even if you owe the money, don’t make promises or payments right away.
Why?

🚨 Some debts are too old to sue you for (called “time-barred”).

If you say something like “I’ll pay soon,” it can restart the clock.

📞 5. Get an Unlisted Number.

Regular phone numbers from cell or landline companies are sold to creditors. Just getting a new number will only stop the calls for a short time. The number has to be actually UNLISTED. You have to pay for an unlisted number. If you want, VOIP numbers are often unlisted, but no guarantees.

Remember, whoever you give out your unlisted number to can unwittingly give it to a bill collector, so make sure everyone you give your new number to knows not to give it out to anyone, no matter who they say they are! Fact: Bill collectors lie all the time.

🎙️6. Record the Call.

Just saying you are recording the call will make most bill collectors hang up immediately. They break the law all the time, and if you record the call, you have proof and you can easily sue them in small claims court and get maybe $1,000 per call!

Fact: In NC, you can record calls without the other party knowing. As long as one person on the call knows it is being recorded (you) you are fine. This is a good way to collect proof that they are breaking the law for a lawsuit later!

🛑 7. Don’t Ignore It Forever

BEWARE: avoiding creditors can give bill collectors a reason to call family, friends, and EMPLOYERS. It can also make them sue you sooner.

If they sue you in court and you don’t show up, they can win automatically. Then they could:

    • Garnish your paycheck
    • Take money from your bank account
    • Take your property like a house or a car….

So yes, avoid the calls… but don’t avoid solving the problem.
